What Is SB 721 ?

What is SB 326 ?

California SB 326 (Senate Bill 326) is a law aimed at enhancing safety in condominium buildings by requiring inspections of Exterior Elevated Elements (EEEs), such as balconies, decks, and walkways, in condominiums governed by homeowners’ associations (HOAs). These inspections help identify structural deficiencies, deterioration, or safety hazards, ensuring that these elements remain safe and compliant with building standards.

Why It's Required ?

The law was introduced in response to safety concerns following high-profile balcony collapses, including the 2015 Berkeley tragedy. SB 721 and SB 326 mandates regular inspections to prevent similar accidents and protect residents, tenants, and property owners from potential liability due to structural failures.​

Who Needs It ?

Both SB 721 and SB 326 mandate inspections of Exterior Elevated Elements (EEEs) on multi-family residential buildings. SB 721 applies to property owners of buildings with three or more dwelling units used as rentals, while SB 326 applies to condominium buildings governed by homeowners’ associations (HOAs). These laws ensure that structural components primarily supported by wood or steel are regularly inspected for safety, helping to prevent failures and maintain compliance with California building standards.

Inspection Deadline ?

The initial inspection deadline differs for SB 721 and SB 326. For SB 326, homeowners’ associations (HOAs) managing condominium buildings must complete their first inspection by January 1, 2025. For SB 721, property owners of multi-family rental buildings must complete their first inspection by January 1, 2026. Failure to meet these deadlines may result in penalties. After the initial inspection, SB 721 requires re-inspections every six years, while SB 326 mandates inspections every nine years to ensure ongoing safety and compliance.
